Drug Possession

Having illegal drugs on your person, in your vehicle or in your place of residence is considered drug possession.  Examples of illegal drugs include:

The charges brought against you will be determined by the type of drug, the amount of the drug, the jurisdiction in which you were caught, and other circumstances of the case. Penalties for drug possession can range from probation and a minor fine to a lengthy term in prison.

For instance, in some areas, being caught with marijuana will get you nothing more than a slap on the hand.  However, the typical drug possession discovery will result in your immediate arrest, even if you do not serve any jail time. In South Carolina, your first offense of simple possession of marijuana is treated as a misdemeanor. You may face up to 30 days incarceration and a fine.

Drug Sales and Distribution

There is generally a difference between possessing small amounts of a drug that are likely for personal use and the "possession with intent" of large quantities for sale or distribution. When the offender is caught with a larger amount, it is presumed that he or she intended to sell the drug and the penalties will be harsher and the prison sentences longer.

Repeat offenders are also prosecuted with more severe penalties, as are offenders caught in possession of larger quantities within close proximity of day cares, schools, and universities.
